Upon entry of a second or subsequent civil or criminal judgment finding that an Owner, Beneficial Owner, Occupier and any other person in charge or control of the affected Property is responsible for a condition that may be abated in accordance with this Chapter, within a two (2) year period, except for conditions abated pursuant to Section 17980 of the California Health and Safety Code, the court may order the Owner, Beneficial Owner, Occupier and any other person in charge or control of the affected Property to pay treble damages.
