For the health, welfare and safety of children, it is provided that any dog found not in the custody and control of the owner at, upon or near any school yard, bus stop, road, street, alley or highway where one (1) or more children are in route to or from school or home, or where children are gathered, may be forthwith seized by any peace officer, or by the Animal Control Officer or his/her deputies, and impounded by the Animal Control Officer.
