There exists within the County of Humboldt economically distressed areas which may be benefitted by efforts to prevent the loss of existing jobs and to create new jobs. In the interest of the health, welfare and safety of the people of the County of Humboldt and the State of California, it is necessary to provide an alternative method of financing certain facilities in order to prevent the loss of existing jobs in the County and to increase employment opportunities and otherwise contribute to the economic development of said County. The California Industrial Development Financing Act, California Government Code §§ 91500 et seq. (the “Act”), has created in the County of Humboldt a public corporate instrument of the State of California known as the Industrial Development Authority of the County of Humboldt, for the purpose of exercising powers granted by the Act. § 91520 of the Act provides that a public agency shall have the power to transact any business or exercise any powers of an authority conferred by the Government Code without having to establish an authority. However, a public agency may, at its option, establish an authority pursuant to the provisions of Government Code to exercise any applicable powers conferred by the Government Code.
